Terms of Service

These terms (“Terms”) govern your use of Suplay Games & Tools at minigames.suplay.nl (the “Service”), operated by suPlay B.V., Ruwerstraat 9, 7545 SM Enschede, The Netherlands (“suPlay”, “we”, “our”). By using the Service you agree to these Terms.

1. The Service

Suplay Games & Tools is a free web app offering short interactive learning games for procurement, negotiation, and decision-making education. It is provided as-is, without warranty, for educational use by students, teachers, and professionals.

2. Free use

The Service is free to use. There are no accounts, no subscriptions, and no payment. We may introduce optional paid features in the future, but the current core games will remain free for educators and students.

3. Acceptable use

You agree not to:

Submit unlawful, harassing, or abusive content via any user-input field (e.g. display name, BATNA card text);
Attempt to reverse-engineer, scrape, or programmatically flood the Service in a way that degrades performance for others;
Use the Service to harvest data about other users or to compile a dataset for redistribution;
Circumvent rate limits, abuse class codes, or impersonate other users.

We may rate-limit, block, or remove content that violates these terms, in our reasonable discretion.

4. Content and ownership

The games, scenarios, learning objectives, debrief texts, and visual design are © suPlay B.V. They are made available for personal educational use; you may not copy, modify, or redistribute them for commercial purposes without written permission.

Content you enter (your display name, your BATNA card text) remains yours; by submitting it you grant us a non-exclusive licence to store and display it within the Service as necessary to run the games and the cohort dashboard.

5. No warranty

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee continuous availability, error-free operation, or any specific learning outcome.

6. Limitation of liability

To the maximum extent permitted by applicable law, suPlay B.V. is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for direct damages, if any, is limited to one hundred euros (€100). Consumer rights under mandatory EU law are unaffected.

7. Modifications

We may modify these Terms. Material changes will be reflected in the “Last updated” date. Continued use after a change constitutes acceptance.

8. Governing law

These Terms are governed by the law of the Netherlands. Disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the competent courts of Enschede, The Netherlands, except where mandatory consumer-protection law gives a consumer the right to sue in their country of residence.
